Is CBD Legal? Ben & Jerry's Waits to Add Marijuana Substance to Ice Cream Until After FDA Hearing

Ben & Jerry’s ice cream is ready to add CBD to its repertoire, but not until it’s legal. The company announced their pending decision in a statement on their website Thursday.


“You probably already know that we’re fans of all things groovy — think: Half Baked and Dave Matthews Band Magic Brownies,” the statement began. “So it’s no surprise that we can’t wait to get into the latest food trend: cannabidiol, or CBD. We are committed to bringing CBD-infused ice cream to your freezer as soon as it’s legalized at the federal level.”


Some CBD users may be confused, as CBD can be legally bought at a variety of American retailers already. While CBD is legal for personal use, and boasts a wide lineup of health benefits, the Food and Drug Administration has yet to officially approve use of the marijuana derivative in food and beverages.


Ben & Jerry’s explained that point in its statement. “Currently, the FDA prohibits adding CBD to food and beverages,” the statement explained. “But change is on the horizon: They’ve set a public hearing on the legalization of CBD-infused foods and beverages for May 31st, and we’ve submitted a comment to them in support of legalization.”


Friday could mark a transition to consumers seeing more CBD options in food and drinks. That’s not to say there aren’t already products out there. CBD beverages, in particular, have gained attention as mellower alternatives to caffeine.


Friday’s hearing will aim to uncover potentially “exaggerated health benefits” of CBD, according to CNN. CBD is said to aid pain management, alleviate anxiety and depression and promote relaxation. CBD does not provide a mental or physical “high,” as it contains no THC.
